Korte bijdrage
Het recht van de ouders vindt zijn begrenzing in het welzijn van de kinderen
J.J.L. ten Brink
A court-decision is presented where the natural parents were refused the custody of their 2-year old daugther and the foster-parents were appointed legal guardins. A distinction is made between general arguments, concerning psychological versus biological parenthood, and incidental arguments, concerning this child. these particular biological parents, these foster-parents; with special emphasis on the various statements by professionals. Overaccentuation by professionals of the incidental arguments may lead to a relative weakening of the general statements — with the result that in the next case the child may be returned to his natural parents because there are too few incidental arguments against such a decision.
